The Evolution and Application of Mens Rea in Modern Criminal Law
In the context of criminal law, mens rea (guilty mind) is considered essential in establishing
criminal liability. However, with the rapid advancement of technology and the introduction of
new forms of crime (such as cybercrime), the application of mens rea has become increasingly

Guilty mind in Latin is known as “Mens rea” and is viewed as one of the important elements in
crime ("Mens Rea", 2013). Actus non facit reum nisi mens sit rea” is a Latin phrase used to
express that the common test of criminal liability under law is that the act is not culpable unless
the mind is guilty. As the technology advances, nature of crime also has advanced making it
comparatively more difficult to prove any crime on the basis of mens rea or guilty mind in the
US. Under this principle, the mental element to offence should be proved with a subjective or
objective test, where the court must be convinced about the accused of possessing the required
mental element at the relevant time such as purposely, knowingly, recklessly etc; objective,
where the requisite mens rea element is imputed to the accused, on the basis that a reasonable
person would have had the mental element in the same circumstances. ("Mens rea", 2013). In
other words, men rea should be accompanied with actus rea or a guilty mind should also be
accompanied with the act of committing the crime otherwise it is no crime at all. The court
cannot try a person who has just thought of committing a crime nor have a mental state of the
commitment of a crime but mens rea should be supported by evidence from the prosecution.
